Predatory marriage and probate

About The Webinar

The concept of ‘predatory marriage’ may be unfamiliar to many, but the harm caused can have serious and permanent testamentary effects. The term is generally applied to forced marriages faced by individuals (usually elderly) whose mental capacity is in doubt or who are vulnerable to undue influence. S.18 Wills Act 1837 provides that in most circumstances a valid Will is automatically revoked by a marriage. This applies even if the marriage is predatory in nature.  

During the webinar we consider:

  • The law which sits behind it and what can be done to prevent the harm caused

  • We also discuss the recent case of Langley v Quin which involved allegations of predatory marriage in a probate claim
