Abstract

The Petersen (Oudtshoorn) v State case paved the way for the criminal prosecution of Municipal Officials in terms of Section 173 MFMA. Understanding and interpreting sections 171, and 172 read with 173 empowers us all to fully understand the implications of the failure to address non-compliance with the legislation. Let us journey through case studies and explore the unchartered waters.
