"The Skin Virome: recent science and product claims in the COVID-19 era"

The skin virome is understudied when compared to studies conducted on the overall skin microbiome. Recent research suggests it is highly diverse but a few representing viral genus are common on human skin and commonality can be also found with animals such as birds, pigs and dogs. While viruses in general are perceived as harmful, and while many of them are, most will remain latent after primary infection in immunocompetent individuals. Moreover, bacteriophages which are viruses that infect bacteria may actually be beneficial to skin’s health.
The COVID-19 pandemic has resulted in many companies making expressed and/or implied claims that their products – from dietary supplements, air purifiers and hand sanitizers – are effective against COVID-19. The Federal Trade Commission and U.S. Food and Drug Administers have issued dozens of warning letters, and the National Advertising Division (NAD) and the Direct Selling Self-Regulatory Council (DSSRC) of BBB National Programs have focused their monitoring efforts on COVID-19 claims.
This presentation will focus on the latest research on the skin virome, its complex short- and long-term effect and industry unmet needs related to it as well as the presence of COVID-19 on skin and potential implications. It will also provide an overview of NAD and DSSRC, and guidance to companies on how to support advertising claims, particularly those focusing on health and safety, to ensure that they operate on a level playing field, reinforce consumer confidence by making truthful and accurate claims and not running afoul of regulatory precedent and guidance.

About Dr. Nava Dayan
Nava Dayan, PhD, is founder and president of a skin science and research consultancy serving the pharmaceutical, cosmetic, and personal care industries. Dr. Dayan’s 30 years of experience in the greater skin care segment, have yielded more than 150 publication credits in numerous industry-respected journals, five books, including the recently published Handbook of the Skin Microbiome as well as an In-Cosmetics Gold Award for innovation and commensurate recognition from the NYSCC and the CRS for excellence. Dayan holds a Ph. D in pharmaceutics from the Hebrew University in Jerusalem and is the bearer of several patent applications for original work in skin actives and delivery systems. Dr. Dayan services focus on innovation, bridging technology to industry, identifying paths in product development, efficacy claims, safety assessment, skin absorption, increased efficacy and strategies to attenuate adverse effects. Dr. Dayan is the recipient of the 2020 Florence Wall women in cosmetic chemistry award in recognition for significant accomplishments to the cosmetic industry through technical contributions, leadership skills and business excellence.
About Peter C. Marinello
Peter C. Marinello is a Vice President at BBB National Programs. In this role, he serves as Director of BBB National Programs' Direct Selling Self-Regulatory Council (DSSRC), a national advertising self-regulation program for the direct selling industry. Mr. Marinello has over 25 years of experience in advertising self-regulation, starting as a staff attorney at the Council of Better Business Bureaus’—now BBB National Programs—National Advertising Division (NAD) in March of 1993, and later becoming NAD Associate Director in 1998.
Mr. Marinello has written over 1,500 self-regulatory decisions on various advertising topics and products including earnings claims, online advertising, negative option offers, dietary supplements, nuclear energy, and financial services, and has spoken on behalf advertising self-regulation at trade conferences and workshop seminars throughout the country. He has also authored a number of articles regarding advertising self-regulation in various trade publications.
About Howard Smith
Howard J. Smith is a Senior Staff Attorney with the Direct Selling Self-Regulatory Council (DSSRC). Prior to joining DSSRC, Howard was a commercial counselor and litigator in private practice handling complex matters across a broad array of subject matters including false advertising disputes, intellectual property and bankruptcy matters. Howard has substantial first and second chair trial experience as well as experience reviewing, analyzing and drafting contracts, license agreements and settlement agreements for a wide variety of commercial clients.
Howard’s notable achievements for varied clients include successfully arguing an appeal to the Second Circuit for a Fortune 200 client, winning two breach of contract trials in New York state court, winning a defense verdict in a two-week jury trial in California state court, obtaining dismissal of all claims against his client in a “bet the company” advertising and trademark dispute, and favorably resolving as co-counsel seven litigations arising from real estate investments in excess of $1 billion. Howard also has significant experience as an advertising attorney handling advertising disputes before the National Advertising Division (NAD) of the Advertising Self-Regulatory Council and with consumer perception surveys in both NAD and Lanham Act matters.
Howard received his bachelor’s degree at Vassar College and is a graduate of St. John’s University School of Law.
About Annie M. Ugurlayan
Annie Ugurlayan is an Assistant Director at the National Advertising Division (NAD) and Deputy Director at the National Advertising Review Board (NARB) of the BBB National Programs. She joined NAD in 2003 and handles a wide variety of cases. She has also successfully argued appeals before the National Advertising Review Board. Annie oversees case management, NAD’s monitoring cases, and advises first-time participants on the NAD Procedures and process. She is NAD’s liaison to the local Better Business Bureaus. Annie is also a frequent lecturer at conferences nationwide and abroad, particularly on cosmetics advertising on which has developed an expertise. She became Deputy Director at the NARB in 2019. Annie oversees NARB’s administrative matters and drafts NARB compliance decision on behalf of NAD.
Prior to joining NAD, Annie was an associate at O’Hare Parnagian LLP where she focused on real estate transactions and general litigation. She is also a published author and is actively involved in various bar associations, including Co-Chair of the Advertising Disputes and Litigation Committee of the ABA’s Section of Antitrust Law. Annie is the Treasurer of the New York Women’s Bar Association Foundation and is a Fellow of the American Bar Foundation. Annie is fluent in French and Armenian and proficient in Romanian. She is a graduate of Hamilton College (B.A., magna cum laude) and the Maurice A. Deane School of Law at Hofstra University
About Perry Romanowski, Moderator
Currently Chair of the IFSCC Education Committee, Perry has been involved with the Society of Cosmetic Chemists (USA-Canada) for years. He served as SCC President and has served on too many Committees to list here.
